Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 380/ 511, 457/34 of the Indian Penal Code.

It is alleged that the informant being the police officer received information that three persons had gone in the Gramin Bank and one person is waiting in the Auto for committing theft. On chase one person was apprehended, who disclosed his name Ram Kumar Paswan and also disclosed the name of other three persons namely Muni Lal Mandal, Shrawan Mandal (petitioner) and Sunny Choudhary who escaped from the scene.

It is submitted by the learned counsel for the petitioner that merely on suspicion accusation has been

Patna High Court Cr.Misc. No.37912 of 2015 (2) dt.18-09-2015 levelled. No recovery has been made from the possession of the petitioner and the person apprehended on the spot has already been granted bail.

The aforesaid facts constitute ground for consideration of prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Sanhoula P.S. Case No. 77 of 2014, pending in the court of learned Sri Mukesh Kumar, Judicial Magistrate, Ist Class, Bhagalpur. With this observation this application is disposed of.
