JUSTICE ARUN KUMAR ORAL ORDER 10-01-2018 Heard learned counsel for the petitioner and the learned APP appearing on behalf of the State. Petitioner, already in custody, seeks bail in connection with Khanpur P.S. Case No.90 of 2017, registered under Sections 25(1-b)a/26/35 of the Arms Act.

The allegation in brief is that the police recovered one country made pistol from possession of the petitioner and one live cartridge from possession of another co-accused. Learned counsel for the petitioner submits that only country made pistol is said to be recovered from possession of the petitioner but without any live cartridge and he has clean antecedent, moreover he is in custody since 15.07.2017. Having considered the said facts and circumstances, petitioner Rajbali Paswan @ Rambali Paswan is directed to be

No.62502 of 2017 (2) dt.10-01-2018 2 /2 released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Samastipur in connection with Khanpur P.S. Case No.90 of 2017, with condition that the petitioner shall be present on each and every date before the trial court and in case of absence on two consecutive dates without any medical urgency, his bail bond shall liable to be cancelled.
