JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-02-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 363 and 366(A) of the Indian Penal Code.
The prosecution case is that on 17.10.2015 the informant was sleeping in the house when his neighbour Dhananjay Paswan informed him that Raju Paswan enticed away the daughter of the informant when the informant went to the house of Raju Paswan, the petitioners being the parents of Raju Paswan got excited to assault the informant. It is alleged that in conspiracy with the petitioners, Raju Paswan abducted the minor daughter of the informant.
Patna High Court Cr.Misc. No.7019 of 2016 (2) dt.16-02-2016 2/2 It is submitted by learned counsel for the petitioners that thrust of accusation is against Raju Paswan. The victim earlier also eloped with Raju Paswan and the informant has subsequently retracted from his initial version and filed a petition to that effect before the learned court below. The same has been brought on record as Annexure-2 to the petition. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.
Considering the thrust of accusation against Raju Paswan, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-III, Bihar Sharif at Nalanda in connection with Sohsaray P.S. Case No. 214 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
