Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 420, 34, 120B of the Indian Penal Code.

The prosecution case is that the informant used to get the money deposited in his account of the cooperative bank through the petitioner. The informant claims to have given Rs. 18,800/- to the petitioner but in the account only Rs. 100/- was found deposited.

It is submitted by learned counsel for the petitioner that there is no proof of the payment but the petitioner is ready to deposit Rs. 19,000/- before learned Court below which will be deposited in some fixed deposit scheme

Patna High Court Cr.Misc. No.33731 of 2015 (2) dt.13-08-2015 2/2 which will be subject to the result of the case. On deposit of the aforesaid amount before learned Court below, learned Court below shall pass appropriate order for release of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Barauni P.S. Case No. 14 of 2010, pending in the Court of learned Chief Judicial Magistrate, Begusarai. Accordingly the application is disposed off.
