Petitioner is apprehending his arrest in a case registered for the offences punishable under Section 135 of the Electricity Act.

The accusation is consumption of electricity energy unauthorizedly. The loss has been calculated to the tune of Rs. 43,800/-.

It is submitted by learned counsel for the petitioner that in the First Information Report the specific accusation of consumption of electricity energy unauthorizedly is against eight persons. The petitioner was not named. Subsequently the name of the petitioner sprang up to the effect that the petitioner claimed himself to be Rajendra Mahto against whom the First Information Report has been lodged. It

Patna High Court Cr.Misc. No.46641 of 2014 (2) dt.21-04-2015 2/2 is further submitted that in order to save the Rajendra Mahto who is also a shopkeeper in the same premises the petitioner has been roped in the present case.

Without expressing any opinion with regard to the merits of the case, let the petitioner deposit Rs. 10,000/- before learned Court below in connection with present case which will be invested in some fixed deposit scheme which will be subject to the result of the case.

On deposit of the aforesaid amount, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Lakhisarai P.S. Case No. 252 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
