JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 03-05-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with Sadar P.S. Case No. 299 of 2016, registered for the offences punishable under Sections 302, 201, 120(B)/34 of the Indian Penal Code.

The brother of the informant, namely, Sumit Kumar, aged 17 years, went to a coaching centre, but did not return. On next day, his dead body was found near railway track.

The learned counsel for the petitioner has submitted that the petitioner is innocent. He is a teacher in English

During investigation, it was detected that the deceased Sumit Kumar was talking with a girl on mobile and he had love and affection with her. Co-accused Prashant Kumar, who has been declared juvenile and was acquitted, has stated that in his confessional statement one Ravi @ Ravi Shekhar of Bibiganj was involved in that occurrence. He has stated further in his confessional statement that Ravi @ Ravi Shekhar was his friend. Prashant Kumar did not mention the parents name of Ravi @ Ravi Shekhar. He has also submitted that the name of the petitioner is also Ravi @ Ravi Shekhar but he is not the person as named by co-accused Prashant Kumar.

Prashant Kumar has stated that Ravi @ Ravi Shekhar was his friend but the petitioner Ravi @ Ravi Shekhar is 30 years of age. He has next submitted that the girl, with whom the deceased is alleged to have relation has also stated that the present Ravi @ Ravi Shekhar was not involved in this case. On the other hand, the learned APP has submitted that the investigation is still going on and the investigating authorities are searching evidence in respect of involvement of the petitioner in the present case.

In my view, the petitioner does not deserve the privileges of bail, which is hereby rejected.
