The petitioner has been in custody since 21.01.2018 in connection with Forbesganj P.S. Case No. 42 of 2018 registered for the offences punishable under Sections 413/414/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that only because the petitioner was travelling without ticket and was suspected to be one of the persons who was fleeing away on the motorcycle, the petitioner has been roped in connection with the present. It is further submitted that another similarly situated coaccused person who was also said to have been fleeing away from the place of occurrence has since been released on regular bail in Cr. Misc. No. 22056 of 2018 vide order dated 04.05.2018.

No.22869 of 2018 (3) dt.14-05-2018 2/2 In view of the aforementioned facts and circumstances and that the petitioner has got no criminal antecedent, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria, in connection with Forbesganj P.S. Case No. 42 of 2018.
