The petitioner is in custody in connection with Barachatty P.S.Case No.458 of 2014 registered for an offence under sections 304(A) and other ancillary Sections of the IPC. The case has been registered on the fardbeyan of Chowkidar when a dead body was recovered. In course of investigation, the brother of the deceased filed a petition before investigating officer after one week and raised suspicion against four persons including this petitioner. The police apprehended one Shankar Das who confessed his complicity in committing murder of the deceased. It has also been submitted that Shankar Das and Saroj Paswan were apprehended by police who confessed their complicity and disclosed the name of other co-accused in
Patna High Court Cr.Misc. No.63038 of 2017 (2) dt.11-01-2018 2/2 committing murder of the deceased. The said accuseds have been allowed bail by another coordinate Benches of this Court in Cr.Misc.No.23067 of 2015, Cr.Misc.No.4680 of 2015 and Cr.Misc.No.51618 of 2015. This petitioner has clean antecedent except one case, i.e., Kotwali P.S.Case No.928 of 2014 registered for an offence under Section 414/34 of the IPC in which case, the petitioner is on bail.
Learned APP opposed the submissions.
Considering the case of this petitioner on similar footing, facts and circumstances of the case, prayer for bail is allowed. Let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Narendra Pal Singh, Judicial Magistrate, Ist Class, Sherghatty, District-Gaya in connection with Barachatty P.S.Case No.458 of 2014.
