Mr. Sri Manoj Kumar - 1 ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-05-2018 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with Biraul P.S. Case No. 495 of 2017, registered for the offence punishable under Sections 363, 366(A) of the Indian Penal Code.

The allegation is regarding the petitioner having kidnapped the victim girl.

The learned counsel for the petitioner submits that the statement of the victim girl made under Section 164 Cr.P.C. would show that no allegation of any untoward incident being caused by the petitioner has been levelled by the victim girl and in fact, the story made out in her

Patna High Court Cr.Misc. No.20594 of 2018(3) dt.17-05-2018 2/2 statement under Section 164 Cr.P.C. is absolutely different from the one narrated in the F.I.R. It is further submitted that the petitioner is languishing in custody since26.02.2018 and he is having a clean antecedent.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Biraul, District-Darbhanga in connection with Biraul P.S. Case No. 495 of 2017.
