JUSTICE SATYAVRAT VERMA ORAL ORDER 05-12-2022 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned Spl. P.P. for the Vigilance. The petitioner apprehends her arrest in a case registered for the offences punishable under Sections 420, 467, 468, 471 and 120(B) of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner is a woman and has antecedent of one case and the informant alleges that petitioner secured appointment as panchayat shikshak based on forged matriculation certificate. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case, it is next submitted that the FIR came to be instituted based on an ex-parte inquiry conducted behind the back of the petitioner, it

Patna High Court CR. MISC. No.61437 of 2022(2) dt.05-12-2022 2/2 is also submitted that had an opportunity been given to the petitioner by seeking explanation, perhaps the present FIR would not have been instituted.

Learned A.P.P. for the State and learned Spl. P.P. for the Vigilance oppose the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Rahui P.S. Case No. 651 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
