JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 406, 420, 379, 328 and 120B/34 of the Indian Penal Code.
It is alleged that the petitioner being the co-villager of the informant administered some intoxicant material to the driver and cleaner of the tractor and took away the tractor of the informant.
It is submitted by learned counsel for the petitioner that in the background of loan dispute, the accusation has been levelled and there is no direct evidence available on record to implicate the petitioner. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.
The aforesaid facts constitute good ground for
Patna High Court Cr.Misc. No.34999 of 2015 (2) dt.20-08-2015 2/2 consideration of prayer for regular bail.
Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Taraiya P.S. Case No. 113 of 2015 pending in the court of learned JM, Saran at Chapra. Accordingly, the application is disposed of.
