JUSTICE ARUN KUMAR ORAL ORDER 06-07-2018 Heard learned counsel for the petitioners, the informant and the learned Additional Public Prosecutor. This is a petition for grant of regular bail in connection with Banka P.S. Case No. 43 of 2017 for offences under Sections 302/34 of the Indian Penal Code and 27 of the

Patna High Court Cr.Misc. No.23042 of 2018(2) dt.06-07-2018 2/2 Arms Act.

Allegation, in brief, is that the petitioner and one Subhan Ansari came armed with pistol at the shop of the informant's father and both shot at him causing his death. Learned counsel for the petitioners submit that the petitioner is old person aged about 75 years and there is no specific accusation that who shot at which part of the body of the deceased.

Learned counsel for the informant submits that there is specific accusation that the petitioner and Subhan Ansari both accused shot at the deceased and two corresponding fire arm injuries were also found as revealed in post mortem report. Having considered the aforesaid facts, circumstances and the specific accusation against the petitioners, the prayer for bail of the petitioners is rejected.
