JUSTICE BIRENDRA KUMAR ORAL ORDER 26-06-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is languishing in custody for the offences punishable under Sections 341/323/325/447/ 307/379/ 385/504/506/34 of the Indian Penal Code.
There is case and counter case between the parties. Allegation against the petitioner is of commission of injury with iron-rod at the head of the informant. The doctor has found grievous injury. Petitioner is in custody since 07.02.2018. Petitioner has stated on oath that he has got no criminal antecedent.
Submission is that there is no allegation of commission of repetition of blow.
Learned counsel for the informant opposed the
Patna High Court Cr.Misc. No.19419 of 2018 (4) dt.26-06-2018 prayer for bail on the ground of nature of allegation against the petitioner.
Considering the nature of allegation and the period already undergone as well as conclusion of the investigation against the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Ballia P.S. Case No.95 of 2017 with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Mkr./- U T
