Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 325, 307, 379, 504, 506 of the Indian Penal Code.
It is alleged that altogether 27 persons came and made assault to the informant on his head and when brother of the informant came to rescue, he was also assaulted and gold chain and cash of Rs. 950/- were snatched. It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.36208 of 2015 (2) dt.08-09-2015 2/2 petitioners that accusation of assault is omnibus and general. The impugned order reflects that injuries were found to be simple caused by hard and blunt substance. There is counter version of the occurrence also.
A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Patna City in connection with Malsalami P.S. Case No. 76 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
