The petitioner is languishing in custody for the offences punishable under Section 307/120 (B) of the Indian Penal Code and 27 of Arms Act.
According to FIR co-accused Saddam and Pappu Khan allegedly fired causing injury to the informant at his right arm and to Pappu Yadav at his right leg.
Submission of the learned counsel for the petitioner is that Pappu Yadav was examined by the police and he had named one Pappu Khan having different parentage and different residence. He further submits that the informant has not even disclosed parentage and the address of the said Pappu Khan.
Patna High Court Cr.Misc. No.17788 of 2018 (4) dt.18-06-2018 Petitioner was apprehended on suspicion. He has got no criminal antecedent.
Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Muffasil (Mahadeva O.P.) P.S. Case No.426 of 2017, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
