Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 379, 504/34 of the Indian Penal Code. The prosecution case is that one Balister Yadav assaulted Daya Shankar Mishra and when the informant and others were taking Daya Shankar Mishra to the hospital then all the accused persons including the petitioners surrounded them and co-accused Mukhdeo Yadav caught hold the informant and petitioner No. 1 gave farsa blow on the head of the informant thereafter petitioner No. 2 assaulted with lathi to the informant. It is alleged that co-accused Pandeo Yadav snatched rupees nine thousand of the informant and some

Patna High Court Cr.Misc. No.36541 of 2015 (2) dt.15-09-2015 2/2 other accused snatched gold chain worth rupees thirty thousand.

It is submitted by learned counsel for the petitioners that injury on the head of the informant has been found to be sharp cut simple in nature and there is counter version of the occurrence also.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioners surrender within a period of six weeks in connection with Paharpur P.S. Case No. 84 of 2015, pending in the Court of learned Chief Judicial Magistrate, East Champaran at Motihari. With the observations above, the application stands disposed off.
