The petitioner apprehends his arrest in a case registered for the offence under Section 307 & other allied sections of the Indian Penal Code and Section 27 of the Arms Act.

As per the prosecution case, 20-25 persons did 5 - 6 round firing to steal sand from the river and thereafter, they set two tractors on fire.

It is submitted on behalf of petitioner that petitioner is owner of one of the burnt tractor, bearing Registration no. BR21GA/6628. As a matter of fact, on the alleged date of occurrence, the tractor of the petitioner was intercepted and the accused set the tractor of the petitioner on fire and petitioner has been made accused only because he is owner of one of the tractor, which was burnt. Petitioner has got clean antecedent.

No.67177 of 2021(2) dt.18-07-2022 2/2 Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Avinash Kumar, learned J.M. III, Nalanda at Biharsharif in connection with Bind P.S. Case No. 18 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
