JUSTICE RAJESH KUMAR VERMA ORAL ORDER 30-07-2025 Heard Mr.Mritunjay Kumar, learned counsel for the petitioner, learned counsel for opposite party No.2 and Mr.Ganesh Prasad Singh, learned Additional Public Prosecutor for the State.

2. The present application has been filed for cancellation of bail bond of opposite party No.2. The opposite party No.2 has been granted bail by order dated 03.04.2023 passed in Cr. Misc. No. 15495 of 2020 in connection with Giryaki @ Giriyak P.S. Case No.359 of 2019 on the basis of the compromise which took place in the Mediation process. As per memorandum of agreement, the opposite party No.2 is

Patna High Court CR. MISC. No.64938 of 2023(11) dt.30-07-2025 2/3 required to deposit 20% of the agreed amount i.e. Rs.6,60,000/- (Six Lakhs Sixty Thousand) by 31st March 2023 and the rest amount will be paid by end of June, 2023.

Learned counsel for the petitioner submits that although the opposite party No.2 has paid 20% of the agreed amount on 31.03.2023 but thereafter he has not paid the rest amount i.e. 80% of the agreed amount by end of June, 2023 then the petitioner has filed this case for cancellation of bail bond of opposite party No.2.

Learned counsel for the petitioner submits that on the instruction of reason the Counsel for opposite party No.2 has taken adjournment to comply the order of this Court but till date he has not complied the same and he has paid very meager amount to a tune of Rs.14,0000/- (Fourteen Lacs) including Rs.6,60,000/- (Six Lakhs Sixty Thousand) and he has not paid the rest amount as yet.

5. Considering the aforesaid facts, this Court has no other option except to cancel the bail bond of opposite party No.2.

6. Accordingly, the opposite party No.2 has been granted bail by order dated 03.04.2023 passed in Cr. Misc. No. 15495 of 2020 in connection with Giryaki @ Giriyak P.S.

Patna High Court CR. MISC. No.64938 of 2023(11) dt.30-07-2025 3/3 Case No.359 of 2019 is hereby cancelled and this application stands allowed.
