JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 03-03-2015 The petitioner is in custody since 03.04.2014 in relation to Bhadaur P.S. Case No. 18 of 2014 instituted under Sections 363, 366, 366(A)/34 of the Indian Penal Code.

The attention of this Court has been drawn to the statement under Section 164 of the Code of Criminal Procedure recorded in respect of the victim. She is stated that the petitioner had come and taken her away on a Motorcycle. Learned counsel states that if a person had to drive the Motorcycle, he cannot be forcibly kidnapped the victim. It is also submitted that the victim is a major girl. Be that as it may, the above petitioner, namely, Deepak Paswan @ Deepak Kumar, shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Barh, Patna, in connection with Bhadaur P.S.
