The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 448, 323, 341, 354, 379, 436, 427, 34 of the Indian Penal Code. Accusation is of making naked and assault to the informant. It is also alleged the petitioner set the house of the informant on fire and took away Rs.2000/-.

It is submitted by learned counsel for the petitioner that for a petty dispute, the accusation has been levelled. Moreover, the informant has retracted from initial version and has filed a petition to that effect before the learned court below, the same has been brought on record as annexure-2 to the petition. The aforesaid facts constitute ground for

Patna High Court Cr.Misc. No.36136 of 2015 (2) dt.08-09-2015 2/2 consideration of prayer for regular bail. Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Forbesganj P.S. Case No.45 of 2014, pending before the learned Chief Judicial Magistrate, Araria.

With the above observation, this application is, accordingly, disposed off.
