The petitioner seeks bail in a case registered for offences under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, allegedly there is recovery of 594 litres of foreign liquor from the hay house (Bhusha Ghar) of the petitioner in his absence which has been constructed 10 meters away from his house. It is contended that the petitioner does his business at Kolkata and he was not apprehended from the spot. His prayer for

Patna High Court Cr.Misc. No.55654 of 2017(2) dt.23-11-2017 2/2 anticipatory bail was rejected by 21.04.2017, thereafter, the petitioner surrendered on 07.10.2017 and since then he is in custody. It is claimed that the petitioner is having clean antecedent.

Considering the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Excise, Vaishali at Hajipur in connection with Jurawanpur P.S. Case No. 03 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
