Petitioner seeks bail in a case registered for the offences punishable under Sections 8/20 (b)(ii)(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Two persons started fleeing from a tempo and they were apprehended by the police at the spot. Thereafter, from the tempo 20 Kg. of Ganja was recovered.

Submission is that the identity of the tempo was not disclosed in the F.I.R. nor it is clear as to whether the petitioner was passenger or driver of the same. The recovered Ganja was not of the petitioner. Petitioner is in custody since 16.09.2017. The report of the learned trial Judge reveals that charges have already framed in this case.

No.17904 of 2018 (4) dt.26-06-2018 2/2 Considering the nature of material, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Bidupur Police Station Case No. 282 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner as well as condition that both the bailors shall be resident of within the territorial jurisdiction of the court below.
