JUSTICE MOHIT KUMAR SHAH ORAL ORDER 02-07-2018 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with Rajepur PS case no. 143 of 2017 instituted for the offences punishable under Sections 20, 22, 23 of N.D.P.S. Act. The allegation is regarding recovery of 8 kg. of ganja from the petitioner herein.

The learned counsel for the petitioner submits that the commercial quantity of ganja under the N.D.P.S. Act, 1985 is 20 kg. whereas only 8 kg. has been recovered from the petitioner herein. The petitioner is said to be having a clean antecedent and he is in custody since 07.11.2017.
