The petitioner has renewed his prayer for grant of bail in a case registered under sections 302 and other sections of the Indian Penal Code.

The earlier application for bail of the petitioner was rejected vide order dated 14.9.2021 passed in Cr. Misc. no.15844 of 2021.

As per the prosecution case, the petitioner and other accused persons variously armed with different weapons are said to have assaulted Ravindra Yadav leading to his death. It is submitted by learned counsel for the petitioner that the petitioner is in custody since 21.9.2020 and has no criminal antecedent. Referring to the statement made in paragraph no.9 of the petition, it is submitted that charge has

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations in the case, the petitioner having remained in custody for over 2 years since 21.9.2020 and charge having been framed in the learned trial court, the Court directs the petitioner to be enlarged on bail in connection with Sessions Trial no.176 of 2020 (arising out of Pipra P.S. Case no.152 of 2020) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional District and Sessions Judge, Supaul.
