JUSTICE SANJAY KUMAR ORAL ORDER 20-12-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners seek bail in connection with Aurangabad (Town) Police Station Case No. 344 of 2017 registered for offences punishable under sections 420, 468, 471 and 120(B) of the Indian Penal Code.
The above case has been registered on the basis of written report of District Fisheries Officer-cum-Chief Executive Officer, Aurangabad. It is alleged that in course of checking on the gate of examination hall, one mobile was seized from the possession of one of the examinee. It is alleged that the said mobile was to be used for getting answer through What's App.

Considering the facts and circumstances of the case, the prayer of bail is allowed and the above named petitioners are directed to be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad (Town) Police Station Case No. 344 of 2017, subject to the following conditions:- (i) One of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioners will not induce any witness or tamper with the evidence.
(iii) The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court and on the event of failure on their part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of their bail.
(iv) If the petitioners are found involved in similar type of offence in future, the prosecution will have liberty to move for cancellation of their bail. (Sanjay Kumar, J) Mahesh/- U T
