The petitioner is in custody since 16.09.2017 in connection with Chakia P.S. Case No. 76 of 2009 for the offence registered under Sections 395, 397 and 412 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is not named in the first information report but his name has figured during the course of investigation on the confessional statement made by one Mahadeo Bhagat before the police, which has no evidentiary value. It is further submitted that the petitioner has not been put on T.I. Parade and the petitioner has no criminal antecedent.

Patna High Court Cr.Misc. No.21892 of 2018 (3) dt.10-05-2018 Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran, Motihari in connection with Chhakia P.S. Case No. 76 of 2009.
