The petitioner seeks bail in a case registered for the offence under Sections 341, 323, 307, 379/34 of the Indian Penal Code and Section 27 of the Arms Act.

As per the F.I.R., this petitioner alongwith one another co-accused caused fire-arm injury to the informant and looted away cash of Rs. 95,000/- from the shop and mobile phone from the informant.

It is submitted on behalf of petitioner that during course of investigation, the informant of the case Vivek Kumar has categorically stated that it was co-accused Rohit Kumar, who caused fire-arm injury to him. So far as this petitioner is concerned, there is no allegation of causing fire-arm. Petitioner claims clean antecedent and he is in custody since 16.09.2021.

Patna High Court CR. MISC. No.66739 of 2021(3) dt.18-04-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the nature of accusation, period of custody and the fact that petitioner has got clean antecedent, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad in connection with Amba P.S.
