The petitioner seeks bail in connection with Mufassil (Lakho) P.S. Case No. 499 of 2020 instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner is in custody since 20.09.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that allegation is of recovery of 90 liters foreign liquor from the field of Bidur Singh.

No.67146 of 2021(2) dt.18-02-2022 2/2 Learned counsel for the petitioner submits that petitioner was not arrested from the spot and has been alleged to have been identified by people while he was fleeing after seeing the police and his name came in the confessional statement of co-accused.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 20.09.2021, charge-sheet has been submitted in the case and the petitioner is a person with clean antecedent and he was not arrested from the spot, let the petitioner above named be released on bail on furnishing bail bond of Rs. 2,000/- (Rupees Two Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cumSpecial Judge, Excise Act, Begusarai in connection with Muffasil (Lakho) P.S. Case No. 499 of 2020.
