JUSTICE ASHUTOSH KUMAR ORAL ORDER 21-12-2017 The petitioner seeks bail in connection with Sessions Trial No. 173 of 2017, arising out of Motihari Town P.S. Case No. 178 of 2014 dated 28.03.2014 instituted for the offences under Sections 341, 323, 325, 329, 307, 382, 504, 506, 34 of the Indian Penal Code.

The petitioner and another are said to have assaulted the informant by means of iron rod and butt of the firearm weapons. The informant has suffered five injuries on his person but those injuries are simple in nature. The petitioner is in custody since 27.03.2016. Apart from the present case, the petitioner has been made accused in another case of the same police station for similar nature of offences from where the petitioner was remanded

After the framing of the charge, one prosecution witness has been examined.

Regard being had to the period of custody of the petitioner, this Court is inclined to grant bail to him. The petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned 12th Additional Sessions Judge, East Champaran at Motihari in connection with Sessions Trial No. 173 of 2017, arising out of Motihari Town P.S. Case No. 178 of 2014. The petitioner, shall, however participate in the trial and would not do anything to impede the early conclusion of the trial. Should he attempt to do so, it will be open for the Trial Court to cancel his bail and take all coercive steps for taking him into custody and thereby securing his attendance at the trial.
