2. Petitioner seeks pre-arrest bail in connection with Halsi P.S.Case No.16 of 2024 registered for the offences punishable under Sections 457, 380 and 411 of the Indian Penal Code .

3. As per the allegation made in the FIR, theft was committed in the godown of decoration articles of the informant by breaking its wall and a vehicle bearing registration no.WB38R2000 was seized along with the stolen articles.

4. Learned counsel appearing on behalf of the petitioner submitted that the said vehicle was not being driven by the petitioner and due to the village politics, the petitioner being of neighbouring village has been implicated in a false

Patna High Court CR. MISC. No.59457 of 2024(2) dt.11-09-2024 2/3 case. Admittedly, the vehicle is not registered in the name of the petitioner and he has no concern in any manner with the said vehicle.

5. Learned APP for the State has vehemently opposed the prayer for grant of pre-arrest bail to the petitioner.

6. Having considered the rival submissions made on behalf of the parties, as well as, the recovery was made from a vehicle bearing registration no. WB38R2000 and the petitioner has pleaded that due to enmity with the informant, he has been roped in the present case, the learned district court is directed to call for the report from the District Transport Officer in respect of the vehicle in question. The District Transport Officer soon after the knowledge of this order is required to furnish the report in connection with the vehicle bearing registration no. WB38R2000 on the basis of its registration number, engine number and the chessis number and shall also provide information about the owner of the vehicle to the learned district court and in case, the petitioner is not found the owner of the vehicle on the basis of registration number, engine number and chessis number of the vehicle, the petitioner is directed to be released on pre-arrest bail in connection with Halsi P.S.Case No.16 of 2024, subject to conditions as laid down under

Patna High Court CR. MISC. No.59457 of 2024(2) dt.11-09-2024 3/3 Section 438(2) of the Cr.P.C. and the learned counsel deems fit and proper.

7. With the above observation/direction, the present bail application stands disposed of.
