ANJANA MISHRA ORAL ORDER 31-08-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in Adapur P.S. Case no.49/12 for the offence under Sections 366A, 372 and 376 of the I.P.C.
Learned counsel for the petitioner submits that the petitioner has been falsely made accused in the present case. The victim girl in her deposition before the court below has stated that she herself married in the temple at Sitamarhi with one Mani Bhushan Rai. She has not made any allegation against this petitioner.
Considering the aforementioned facts and circumstances of the case, let the petitioner, abovenamed, in the
Patna High Court Cr.Misc. No.47924 of 2014 (3) dt.31-08-2015 2/2 event of his arrest or surrender before the court below within three weeks from today be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the S.D.J.M.,Raxaul at Motihari (East Champaran), Adapur P.S.Case No.49/12 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
