JUSTICE MADHURESH PRASAD ORAL ORDER 16-12-2019 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner seeks bail in Mufassil P.S. Case no. 399/2018 registered under section 307 and other allied sections of the IPC as well as section 27 of the Arms Act.
Allegation is that while the informant was fishing in the river, two accused came at the spot and they had assaulted the informant and also fired upon him. It is submitted that in the process informant has sustained gun shot injury also. Counsel for the petitioner submits that occurrence is of 10.10.2018, however, F.I.R. has been lodged on 12.11.2018. It is further submitted that F.I.R alleges firing by both accused persons, however, there is one gun shot injury and the allegation
Patna High Court CR. MISC. No.52572 of 2019(4) dt.16-12-2019 2/2 coupled with delay make out no case under section 307 IPC for want of specific allegation against the petitioner. Learned A.P.P. opposes the prayer for bail. It is his submission that the petitioner has large number of cases pending of similar nature which have been disclosed in para 3 of the petition. Specific detail of delay in lodging F.I.R has been given in the F.I.R that the petitioner was undergoing treatment on account of injury suffered at Sadar hospital, Munger. Considering the aforesaid submissions and nature of allegation along with antecedent of the petitioner, this court, for the present, is not inclined to grant bail to the petitioner and accordingly, same is rejected.
