====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 18-08-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307 and 504/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is aged about 72 years. The informant alleges that petitioner started abusing the informant when he asked him to change the direction of the thresher so that dust does not come to his side. It is alleged that thereafter the named accused persons came and started assaulting the informant and his family members with farsa, rod and other weapons on account of which Bholu was injured and became unconscious. Learned counsel for the petitioner submits that from bare perusal of the allegation as alleged in the FIR, it would manifest that as far as this petitioner is concerned, it is alleged that he abused the

It is next submitted that as far as assault is concerned, the petitioner is not alleged to have assaulted either the informant or his family members. It is further submitted that petitioner is a senior citizen, aged about 72 years and is a person with clean antecedent.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Naubatpur P.S. Case No. 211 of 2020, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
