JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 18-07-2022 Heard learned counsel for the petitioner, learned counsel for the Informant and learned APP for the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 354, 504 and 506 of the Indian Penal Code and Sections 65, 66(1) and 67 of the Information Technology Act, 2000.

It is a case of sending vulgar messages on the mobile phone of the informant and threatening as well as abusing her. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that the present case has been lodged only to harass the petitioner on account of a loan of Rs.90,000/- taken by the husband of the informant, namely, Sanjay Kumar (Sanjay

Patna High Court CR. MISC. No.66817 of 2021(2) dt.18-07-2022 2/2 Singh as mentioned in FIR) and not returning the same vide Annexure-2 to the present petition.

Learned APP appearing for the State and the learned counsel appearing for the Informant have opposed the prayer for anticipatory bail and submitted that petitioner has intentionally committed the offence and trying to get the privilege of anticipatory bail.

Considering the aforesaid submissions, let the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Danapur, Patna in connection with Paliganj P.S. Case No. 339 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
