The petitioners have preferred this application for grant of regular bail in a case registered under section 302 and other sections of the Indian Penal Code.

As per the prosecution case, the seven named accused persons including the two petitioners herein are said to have assaulted Sita Devi and Nawita Kumari. As a result of the injuries sustained, Nawita Kumari died.

It is submitted by learned counsel for the petitioners that the petitioners who are ladies have been falsely implicated in the case. The allegations are general and omnibus in nature. The contents of the postmortem report do not support the

Patna High Court CR. MISC. No.67601 of 2021(2) dt.28-04-2022 2/2 assault by seven accused persons. The petitioners are in custody since 29.6.2021 and have no criminal antecedent. Chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the general and omnibus allegation against the petitioners who are females together with them having remained in custody for more than 9 months, both the petitioners are directed to be enlarged on bail in connection with Beldaur P.S. Case no. 138 of 2021 on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Khagaria.
