JUSTICE MADHURESH PRASAD ORAL ORDER 12-12-2017 Heard learned counsel for the petitioner and learned APP for the State.

This is a case registered under Sections 147,148,149,341,323,324,307,302,504 and 506 of the Indian Penal Code.

The FIR discloses that while erecting a temporary boundary wall the incident had occurred between the parties. Counsel for the petitioner submits that as regards the later part of the allegations the petitioner has not been named in the assault. His name has come in the first part of the allegation that he was helping in erecting the temporary boundary wall. He is in custody since 17.4.2017. He also submits that the petitioner who is an old man has clean antecedent.

Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of 2nd Addl. Sessions Judge, Jamui in Jhajha P.S. Case No. 256 of 2016, S.Tr. No. 280 of 2017 subject to the conditions : (i) That one of the bailors will be a close relative of the Petitioner who will give an affidavit giving genealogy as to how he is related with the Petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the Petitioner.

(ii) That the Petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
