Heard learned counsel for the petitioner and the learned APP for the State.

Petitioner seeks regular bail in connection with Industrial Area P.S. Case No. 160 of 2021 registered for the offences punishable under Sections 307, 323, 324, 325, 341, and 379/34 of the Indian Penal Code.

As per the prosecution, an altercation took place in between the informant's mother and this petitioner on account of rent which was demanded by the petitioner. It is further alleged

No.61018 of 2022(3) dt.17-02-2023 2/3 that the petitioner forcefully took away Rs. 50,000/- from his Almirah and snatched golden neckless from his mother's neck and upon protesting the accused persons including this petitioner assaulted the informant and his younger brother with Farsa and rod, owing to which they got injuries. The main submissions advanced by learned counsel Mr. Praveen Kumar appearing for the petitioner are that the petitioner has fair and clean antecedent and has been languishing in jail since 22.02.2022 and both the parties are relatives and in between them a good relation has restored and the petitioner is a student and the informant sustained simple injuries and the injuries upon the person of the informant's brother were found on non-vital part of his body and one similarly situated co-accused person namely Sanjeev Kumar @ Sanjeev Singh @ Sanjeev Kumar Sonu has been granted bail by a co-ordinate Bench of this Court vide order dated 07.07.2022 passed in Cr. Misc. No. 23919/2022.

Learned APP appearing for the State has opposed the bail prayer.

In view of the facts, as stated above and mainly considering the petitioner's fair and clean antecedent and his young age and his custody period, in the opinion of this Court

Patna High Court CR. MISC. No.61018 of 2022(3) dt.17-02-2023 3/3 the petitioner deserves to a lenient approach of this Court. Accordingly, let the petitioner named-above be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned in connection with Industrial Area P.S. Case No. 160 of 2021.
