The petitioner seeks regular bail in connection with Sheosagar(Baddi) P.S. Case No. 391 of 2017, registered for the offence punishable under Sections 8(c)/20(B)/22/27(A) of the N.D.P.S. Act.

The allegation is regarding the police, upon raiding the house of the petitioner, having recovered a plastic bag kept inside the vehicle and from that bag total 5 kg. of ganja was recovered.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case since the vehicle does not belong to him. It is further

Patna High Court Cr.Misc. No.20611 of 2018(3) dt.17-05-2018 2/2 submitted that the recovery of 5 kg. ganja is not a commercial quantity under the Act. It is further submitted that petitioner is languishing in custody since 17.12.2017 and he is having a clean antecedent.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Rohtas at Sasaram in connection with Sheosagar (Baddi) P.S. Case No. 391 of 2017.
