The petitioner apprehends his arrest in Dumra P.S. Case No. 68/2012, registered for the offences punishable under Sections 354, 379, 307 and other sections of the Indian Penal Code. The informant alleged that a girl came and informed that two persons were chasing her. The informant named these two persons as Pappu Paswan and Munna Paswan (petitioner). The informant and his father scolded them and sent the girl to her house. It is further alleged that accused persons came to the house of the informant and assaulted him and others. Learned counsel for the petitioner submits that similarly situated co-accused namely Pappy Paswan and others have been granted regular bail.
Patna High Court Cr.Misc. No.21134 of 2016 (4) dt.25-07-2016 2/2 It appears that petitioner was also chasing the girl along with Pappu Paswan.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
If the petitioner surrender in the court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail learned court below shall consider his prayer for regular bail taking into consideration that other coaccused have already been granted regular bail.
