JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-04-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Jokihat P.S. Case No. 318 of 2015, registered under Section 399 and 402 of the Indian Penal Code.

The accusation is that six named accused persons, including the petitioner, were apprehended by the Police. On search, one loaded country made pistol was recovered from the possession of the petitioner and arms and ammunitions were also found from the possession of the other persons. Learned counsel appearing on behalf of the petitioner submits that regarding recovery of the country made pistol Jokihat P.S. Case No. 319 of 2015 was separately

Patna High Court Cr.Misc. No.9606 of 2016 (3) dt.28-04-2016 2/2 instituted prior to the present occurrence. The petitioner has no criminal antecedent, but after apprehending in the present case the petitioner has been remanded in the six other cases, as detailed in paragraph -03 of the bail petition. The petitioner is in custody since 30.11.2015.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Araria in connection with Jokihat P.S. Case No. 318 of 2015. Out of two sureties, one surety must be the parents / close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
