Two petitioners, have approached this court for initiating contempt proceeding against opposite parties on an allegation of willful disobedience to an order dated 23/1/2012
Patna High Court MJC No.3705 of 2013 (7) dt.21-01-2015 2/3 passed in CWJC No. 1455 of 2012.
The petitioners, with other three persons had approached this court by filing the writ petition i.e. CWJC No. 1455 of 2012 for directing the respondents to pay their arrear of salary with effect from 5/1/2004. It appears from the order i.e. Annexure- '1' that petitioners were provided appointment letter on 31/12/2003 and even thereafter, they were never paid their salary and after about 8 years the petitioners approached this court by filing the writ petition. The writ petition was disposed of with a direction to the Director, Secondary Education, Human Resources Development Department, Bihar, Patna to look into the grievances of the petitioners and pass appropriate order. In this case show cause has been filed on behalf of opposite party no. 1 and 2 and along with the show cause an order has been brought on record as Annexure - 'A' to the show cause.
Learned State Counsel submits that in compliance with the order of the writ court reasoned order has been passed and claim of petitioners has already been rejected. In view of the fact that in compliance with the order of the writ court order has already been passed by the competent authority, the court is of the opinion that no further action is
Patna High Court MJC No.3705 of 2013 (7) dt.21-01-2015 3/3 required to be taken in the present case.
If petitioners feel aggrieved with the order passed by the competent authority, petitioners would be at liberty to assail the same in appropriate proceeding.
