Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 302 of the Indian Penal Code.

The prosecution case is that all the accused persons including the petitioner came at the door of the informant armed with farsa and lathi and assaulted to the brother of the informant and other family members. The brother of the informant was treated at the local hospital and then was referred to the PMCH where he succumbed to the injuries.

It is submitted by learned counsel for the petitioner that in the background of land dispute the accusation has been levelled. The accusation is omnibus and

Patna High Court Cr.Misc. No.37919 of 2015 (2) dt.22-09-2015 2/2 general. It is further submitted that full brother of the petitioner lodged Marhowrah P.S. Case No. 95 of 2015 which was earlier in point of time. During treatment the brother of the informant Amar Puri gave statement to Bhagwan Bazar Police for which Sanha Diary Entry No. 393 was made in Bhagwan Bazar Police Station and the same was forwarded to Morhowrah Police Station but the said Sanha was not registered in the police case and a different version was recorded in the First Information Report. The petitioner's side also received injuries. Moreover considering the general nature of accusation other co-accused have been granted anticipatory bail vide Cr. Misc. No. 30463 of 2015.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Marhowrah P.S. Case No. 99 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
