By this writ application under Article 227 of the Constitution of India the order passed by Subordinate Judge-IV, Patna dated 28.05.2010 in Title Suit No.361 of 2003 has been challenged.

It may be mentioned here that after this order review application was filed before the court below which was dismissed and thereafter before the High Court writ application was filed which was also dismissed. Thereafter review application was filed before the High Court that was also dismissed. Thereafter this writ application has been filed for challenging order dated 28.05.2010 after five years.

In view of the above factual position since the order has already merged in the order passed by the High Court in writ

Patna High Court CWJC No.3338 of 2016 (2) dt.15-07-2016 application as well as the subsequent review application, this writ application again is not maintainable. Accordingly, this writ application is dismissed.
