The petitioner is in custody since 29.09.2014 in connection with Sessions Trial No. 425/2015 arising out of Agamkuan P.S.Case No. 383 of 2014 registered for offences punishable under sections 499A, 402, 420, 467, 468, 471, 498A 489B, 489C, 489E/34 of the Indian Penal Code and under Sections 25 (1-b) a- 26/35 of the Arms Act.

The prosecution case, as per the self statement of one Nagendra Rai, informant before S.H.O., Agamkuan P.S. is that on 28.09.2014 at 5.30 A.M. that when he was on patrolling duty, he received secret informant that near Bhutnath Road T.B. Tower under the boundary wall of half constructed park, some criminals assembled to commit crime, thereafter, the informant alongwith

No.9404 of 2016 (2) dt.29-02-2016 2/3 police force went there, the accused persons namely, Sanjit Kumar Sharma, Vikash Kumar, Lal Babu Thakur, Abhijit Pandey , Kallu @ Ranjan Das ( petitioner) and Dhiraj Kumar Chaudhary were caught and from the possession of Sanjit Kumar Rs. 40000/ were recovered from the ploythene bag in four bundles of Rs. 100/- and also counterfeit currency and one mobile set of L.G. Company and one country made loaded pistol and live cartridges were recovered from the possession of Vikash Kumar with counterfeit currency. From the possession of the petitioner, one country made pistol with live cartridge and mobile phone was recovered. They disclosed that they are members of a gang and are engaged in hoodwinking people by supplying counterfeit notes in the pretext of doubling the money.

It has been submitted that the petitioner is innocent and has been falsely implicated and the other co-accused Vikash Kumar has been granted the privilege of bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 47829 of 2015 on similar allegations on 12.10.2015.

However, learned A.P.P. for the State opposes the prayer for bail Considering the facts and circumstances, the above named petitioner, Kallu @ Rajan Das @ Rajan is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the
