Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks bail in a case registered for the offences punishable under Sections 409, 419, 420, 467, 468/34 of the Indian Penal Code.
Learned Senior Counsel for the petitioner submits that the petitioner is in custody since 07.06.2021, charge-sheet has been submitted and is a person with clean antecedent. The informant alleges that he received an information on 31.05.2021 that the Branch Manager, Asha Parari Branch,
Patna High Court CR. MISC. No.68313 of 2021(4) dt.16-05-2022 2/3 Simiri has committed defalcation of money. Further, an inquiry team was constituted and during course of inquiry it was found that the accused Branch Manager has illegally withdrawn Rs.1.09 crore from the account of customers and defalcated the same.
Learned counsel for the petitioner submits that the name of this petitioner transpired in the confessional statement of co-accused Ravi Shankar Kmar who has been granted bail by order dated 16.05.2022 in Cr. Misc. No. 68445 of 2021. It is, thus, submitted that when the person in whose confessional statement, the name of this petitioner transpired has been granted bail, the petitioner also deserves to be enlarged on bail. Learned Special P.P. for the Vigilance, learned A.P.P. for the State and learned counsel for the Bank opposed the bail application but are not able to meet the submission of the learned counsel that the co-accused in whose confessional statement the name of the petitioner transpired has been granted bail then why the bail of the petitioner should not be considered. Considering the fact that the petitioner is in custody since 07.06.2021, charge-sheet has been submitted and is a person with clean antecedent and taking into consideration the submission made by the learned counsel for the petitioner, the

Case No. 161 of 2021.
