JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-03-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 419, 420, 421, 423, 467, 468, 471, 120B of the Indian Penal Code. The prosecution case is that the informant was in the beneficiary list under Indira Awas Scheme but Rs. 35,000/- in two installments were transferred to the fictitious account opened in the name of petitioner. It is alleged that the said misappropriation was done at the behest of panchayat Mukhiya and Panchayat Secretary in connivance with the bank officials. The petitioner was Branch Manager at the relevant point of time.

No.10700 of 2016 (2) dt.14-03-2016 2/2 returned by the panchayat Secretary and on the basis of the same, panchayat Secretary and panchayat Mukhiya have been granted anticipatory bail by learned Sessions Judge. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the thrust of accusation against panchayat Mukhiya and panchayat Secretary coupled with the statement in para 3 that petition has no criminal antecedent, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Hussainganj P.S. Case No. 28 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
