The petitioner seeks bail in connection with Jogbani P.S. Case No. 34 of 2017 arising out of special case no. 08 of 2017 instituted for the offences under Sections 272, 273 of the Indian Penal Code, Section 30(g), 38 (i) of Excise Act, Section 63/64 of Copy Right Act, Section 27 (b) (a) 28 read with Section 36 AC of Drugs and Cosmetic Act and Section 20/22 of Narcotics Drugs and Psychotropic Substances Act.

On Secret information, the house of one Anil Sah and Amit Kumar Sah was raided and from there huge quantity of cough syrup, drugs and other prohibited articles were recovered. On arrest of the aforesaid Anil Sah and Amit Kumar Sah, both of them disclosed the name of the petitioner as being part of the

Patna High Court Cr.Misc. No.62573 of 2017 (2) dt.22-12-2017 2/2 illegal business of the aforesaid incriminating articles. Learned counsel for the petitioner has submitted that the implication of the petitioner is only on the basis of the confession of the aforesaid co-accused persons. It has further been submitted that aforesaid Anil Sah and Amit Kumar Sah have been granted bail by a Bench of this Court on 07.07.2017. Other coaccused persons also have been granted bail. In this case, the petitioner is in custody since 13.10.2017 and in the two other cases in which he was made accused, he is on bail.

In the facts and circumstances, the petitioner above named is directed to be released on bail on his furnishing bail bond in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge cum Special Judge, Araria in connection with Jogbani P.S. Case No. 34 of 2017 arising out of Special case No. 08 of 2017.
