The petitioners seek bail in a case instituted for the offences under Sections 420, 379, 411 and 414 of the Indian Penal Code.

The prosecution case in short is that the mobile of the informant was snatched by the accused persons. It has been submitted on behalf of the petitioners that the petitioners are in custody since 26.5.2019 and have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. Charge-sheet has been submitted in the present case. The petitioners have falsely been

Patna High Court CR. MISC. No.55339 of 2019(2) dt.04-09-2019 2/2 implicated in the present case. The petitioners had no knowledge that the mobile in question is stolen property. They have not been put on T.I.P. to ascertain whether they have committed theft or not.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj in connection with Kishanganj P.S. Case No. 244/2019.
