JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 20-03-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 341, 323, 379, 307, 406, 410, 120B/34 of the Indian Penal Code.

The prosecution case as per F.I.R. is that all the F.I.R. named accused persons have snatched the videocamera of the informant who is a videographer, when he had gone to Dalsinghsarai in regard to shooting a film. It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely

The informant in the F.I.R. has only alleged against the petitioner that he sent ticket to the informant to come to Dalsinghsarai. The informant has not alleged the presence of the petitioner at the place of occurrence not in any allegation of committing the offence has been raised by the informant against the petitioner. It is also submitted that in the background of some financial dispute the present accusation has been levelled against the petitioner. Nothing has been recovered from the conscious possession of the petitioner. The petitioner is languishing in custody since 19.11.2021. A statement has been made in para 3 of the petitioner that petitioner has no criminal antecedent.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief
