Petitioner is not named in the first information report but in course of investigation, the name of petitioner came in this case.
Submission on behalf of the petitioner is that the present case was lodged against five persons, out of whom, one person has been made accused without disclosing his name but that person was of village Semraon as claimed by the informant. Learned counsel for the petitioner submits that there was no scope of implication of other persons in the present case because the informant has very specifically named four persons and one person of village Semraon without disclosing his name in
Patna High Court Cr.Misc. No.10132 of 2016 (2) dt.03-02-2016 2/2 the F.I.R. and, moreover, on the alleged date and time of present occurrence, the petitioner was in custody.
No doubt, petitioner carries criminal antecedent of several cases but considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara in connection with Charpokhari P.S.Case No. 82 of 2015.
